1.1. Please read the following Terms of Use which
apply to www.morganstanleycard.co.uk ("the Web
Site").
1.2. YOUR USE OF THE WEB SITE IMPLIES THAT YOU ACCEPT
THESE TERMS OF USE.
- Basis of Access to Web Site
We reserve the right at any time to withdraw access
to the Web Site for any purpose which we deem reasonable.
The availability of the Web Site over the Internet
is at our entire discretion.
- Jurisdiction and Geographical Restrictions
3.1. The Web Site is intended to be accessed only
by consumers resident in the United Kingdom.
3.2. These Terms of Use are governed by English Law
and any dispute shall be subject to the non-exclusive
jurisdiction of the English Courts.
- Content
4.1. The Content of this Web Site is the property
of Goldfish Card Services Limited and is subject to
copyright with all rights reserved.
4.2. Whilst we seek to ensure that the content is
accurate and complete, we provide all content AS IS
and without any warranties as to accuracy or completeness.
- Links to Other Web Sites
5.1. On this Web Site you may be offered hyperlinks
to other web sites which you may be interested in.
We provide these links for your information only and
does not accept any responsibility for the content
of those web sites.
5.2. In addition, the Web Site hosts services provided
by other providers such as Liverpool Victoria Banking
Services Limited. You are advised to read each third
party's terms and conditions before contracting with
such third party.
- Modification
We reserve the right in our discretion to change without
prior warning or notice any content on this Web Site
and the Terms of Use under which this Web Site is
used and you are advised to read the Terms of Use
upon every visit to this Web Site.
- Cookies
7.1. When you visit the Web Site we may transfer some
information onto your computer's hard disk ('a cookie')
that enables us to recognise you and helps us to identify
products or services that can be tailored more specifically
to you.
7.2. Cookies are files used by some Internet companies
and services to store your configuration and user
preference information on your computer and to track
user information on their web site. If you access
the Web Site by following a link from certain Web
Sites on which our promotional links or banner advertisements
are shown, we will place a cookie in the temporary
memory of your computer. The cookie that we set in
the temporary memory of your computer is used to maintain
your Account identity as you move from one page to
another within the web site and/or identify from which
other web site you have navigated in order to reach
the Web Site. Some of the cookies we place on your
computer are not removed each time you close your
browser software. Unless your browser is set up to
accept cookies automatically, you may be prompted
to accept a cookie from our Web Site. If such a message
appears, you must accept the cookie if you wish to
use the Web Site. If your browser is currently set
to disable cookies, you will need to change your browser
configuration.
1. Introduction
1.1 This Agreement sets out the terms for using the Account
Centre and email alerts. In this Agreement 'we, us and
our' means Barclays Bank PLC and 'you and your' means
the person who is the primary Cardholder of a Morgan Stanley
Card or any other Card issued by Barclays Bank PLC and
has registered for the Account Centre.
1.2 The features of the email alerts may be varied in
the future and we will tell you about these variations.
We will also tell you about any new or varied services
that will form part of the Account Centre.
2. The Account Centre
2.1 You may register for the Account Centre at any time
by submitting an online User ID and Security ID ('IDs').
2.2 You may cancel access to the Account Centre service
at any time by using our online cancellation form. Your
IDs will then be cancelled immediately. You will not be
able to access information and services in the Account
Centre or receive messages from the email alert service
until you re-register, which you may do at any time.
2.3 All web pages where you are asked to submit Card or
Account related or personal information are situated in
an area which can only be accessed by primary Cardholders
who have been through our security checks ('the Secure
Area').
2.4 We may withdraw your IDs if we think that this is
necessary for security reasons or to prevent misuse of
your Account. We may do this for example if there have
been too many unsuccessful attempts to access the Account
Centre.
2.5 When you have registered for the Account Centre you
can also choose to receive email notifications about the
status of your Account by subscribing to the email alert
service. This service is designed to help you manage you
Account and is described in condition 4 below.
2.6 When communicating by the Internet, we will use the
email address you give us when you register. If your email
address changes you need to inform us immediately by using
the 'Change Your Contact Details' function under 'Update
details' in the Secure Area of the site.
2.7 You must tell us as soon as possible if you:
- Change your name, postal address or telephone number
- Find any failure, delay or error in accessing the
Account Centre or receiving emails
- Want to give us any instructions or notifications
relating to your Account which cannot be dealt with
within the Account Centre
by writing to our Customer Services at the address on
your statement or by calling our Customer Services Advisers
on 0800

2.8 You agree that use of the Account Centre or the email
alert service outside the UK will be at your own risk
and you are aware that accessing our Internet site from
another country may be an offence in that country.
3. Secure Area
3.1 When you enter the Secure Area to:
- View confidential information that we hold about
you or your Accounts in the Account Centre;
- Make an email alert selection or apply for any other
product or service;
we need to check your identity by asking for your Security
ID and your User ID. As long as we are given the correct
IDs, you will be responsible for any selection or application
even if it was made by someone other than you.
3.2 We can refuse to act on an electronic message if for
any reason we think it was not given by you, was not clear,
might cause us to breach a law or contractual duty or
we think your Account is being used for an illegal purpose.
3.3 You must never:
- Tell anyone (including us) your IDs (except when
logging into the Secure Area) or allow anyone else
to use them to access the Secure Area
- Make a written record of your IDs unless you have
disguised it so that it cannot easily be understood
by anyone else
3.4 You must always:
- Do all that you can to keep your IDs secret at
all times
- Make sure that your IDs will not be kept in any
form when accessing the Secure Area (by browser or
any other software) in such a way that other users
of the same work station can get access to the Secure
Area
- Re-register for the Account Centre and email alert
service as soon as possible if:
- You think that someone else knows your IDs
- You have forgotten your IDs
- You think that your IDs have been kept in any
form which allow others access to the Secure Area
3.5 If any of the events in clause 3.4 have occurred,
until you re-register:
- You will be responsible for any e-mail alert selections
or applications for other goods and services which
we receive and act on, even if it was not made by
you
- We will not be responsible for any unauthorised
access to confidential information about you on the
Secure Area
3.6 Our records of your email alert selections and applications
will be conclusive unless there is a clear mistake.
3.7 We will do all that we reasonably can to prevent unauthorised
access to our Secure Area. As long as you have not broken
the other terms contained in this condition 3 we will
accept liability for any loss or damage to you resulting
from any unauthorised access to the Secure Area.
4. Email Alerts
4.1 The email alert service is designed to help you manage
your Account. We will still send you monthly statements
by post and you will be responsible for making sure that
you comply with all the terms of your Card Agreement.
4.2 You can ask us to send you email notifications as
set out on the email alert web page. These will be sent
to the email address you give us when you register. You
will not receive certain notifications until the following
month if you subscribe to email alerts after your billing
statement day.
4.3 Please note the following points:
(a) Emails alerts may contain personal information and
details relating to your Account, such as your credit
limit, current balance etc., depending on the nature of
your selected email notification(s). By registering for
the email alert service and selecting some or all of the
email notification options, you authorise us to disclose
such information to you in this way. If you want to prevent
others from reading emails that we send you, you must
set up your own ID protection on your system at home or
work. Note that you may not be able to prevent emails
being monitored at work. We will not be responsible if
anyone gets access to your emails.
(b) Emails are not sent via a secure link. This means
that the information they contain is not encrypted and
could therefore be read by anyone who intercepts the email.
4.4 You can select one or more of the available email
alert notification options and change your selections
at any time on the email alerts web page in the 'Update
details' area of the secure Account Centre site.
4.5 Although we will do all that we can to send requested
email notifications to you, the email alert service is
simply a tool to help you manage your Account. We will
continue to send you all the information you need by post
to operate your Account. We will not therefore accept
any liability for any loss or damage to you resulting
from any errors or delays in our -mail notifications and
you will therefore still be responsible for any late fees
or overlimit fees charged to your Account.
